BofA wording may cause more foreclosures - Puget Sound Business Journal (Seattle):

ogarawo.wordpress.com
Moore listed the home in Edmonds forabouf $30,000 less than she owed on the mortgage. She thoughy the “short sale” agreement signed with the bank meantr the bank would absorbthe loss. Then she discovere d that her lender, , mightf still come after her forthe difference. That means she may have to let the bank take back her or file for bankruptcy becausershe can’t afford to pay up.
Experts say the wording, whicn was recently and quietly addedr to Bankof America’s short-sale could have major ramifications for a large groulp of distressed homeowners in Washington and across the As one of the country’s largest home lenders and the largest bank by depositd in Washington —Bank of Americaw could end up pushing thousands more homeownersw into foreclosure or personal bankruptcy, said Richard Eastern, a short sale consultant in It’s unclear whether other lenders are following suit. But Bank of Americsa could be harming itself withthis tactic, Easternh says, because the foreclosures would have to be carried on its bookzs until sold.
Bank of Americ also owns , one of the largesg mortgage lenders inthe country. “You’re trying to do the right thingh by selling the said Eastern, of his clients. “But now you’rr going to owe them the difference. That’s huge.” Bank of America said in a statemeng that it asks for a promissoryy note fromsellers — the term used to describe the writte n promise to pay back the differencs — to protect its “investors and shareholdersz from the losses in a shortf sale.
” “Many investors and mortgage insurance companies requirew this process,” according to the The bank declined further While Bank of America’s short-sale agreement wording appears new, Kevi n Kim, a short- sale consultant in Seattle, said other lenderw have similar wording in their agreementa that would require homeowners to pay the moneu left on their loan amount. Bank of America’ short-sale agreement illustrates the financiall complexities facing hundreds of Washington homeowners strugglinyg to deal with underwatermortgages (in which the ownerd owes more than the housew sells for).
It also shows the tug-of-warf between banks and borroweras as banks try to recouop as much money as they can from theidfailed loans. As the foreclosure rate soars in Washington, and more homeowners are turninb toward short sales ina last-ditch attempt to offload their property before foreclosure hurt their credit score, say short-sale experts. Of the single family homes listed onthe , aboutt 12 percent — or 4,400 are listed as short sales, accordin to Eastern, who analyzed homes on the market. The Northwestr MLS doesn’t officially track short sales. But that’sz only an estimate. The real number is likely much as not every short sale is identified as he said.
The number also is growing. Although no loca l agency tracksthose figures, short-sale consultants and real estatwe agents say the volume in Washingto n has jumped dramatically in the last It’s not clear whether other banks will follow suit with Bank of Americ on short-sale agreements, but if they do, that woul d be “alarming,” said Jason president of the and vice president at Elliott Bay Mortgage in Bloom, who only recently learned about the issue, said at leastf two homeowners working with Elliott Bay Mortgag e could be affected it.
While Bloom isn’tg sure why Bank of America would changeits agreement, he said it’s likely the bank is attempting to avoids unnecessary short sales. “They’re trying to recoup any of theitrcosts and, at the very least, try and discourage some people who might be able to make it through without doing a shorr sale,” said Bloom. Short salee could become a dead end for said Eastern, who’s chief executive of . And that woule complicate the clearing of bad debts from thehousintg market. About a third of the 150 homeowners Eastermn is currently working with wouldc be affected by Bankof America’s more stringent shortf sale agreement.
At issude is a sentence in Bankof America’w agreement that says its mortgage servicingt arm “and/or its investors may pursued a deficiency judgment for the difference in the paymentr received and the total balancde due unless agreed otherwise or prohibited by That means Bank of Americaa could pursue a court order against a homeowner after the shorrt sale is completed. Under Washington law, it would have up to six yearsw todo so. That’s a scary proposition for Moore, who doesn’tr want to be on the line for thousandx of dollars after her condois sold.
She boughtg her 600-square-foot home in 2006 and is strugglinb to make herroughly $1,00p monthly mortgage payment while working two minimum-wage jobs and paying student loans for nursing school. She recentlyg put the condo on the marketfor $100,000, abouy $30,000 less than she bought it for duringt the height of the market thre years ago. “I didn’t want to go into because that’s not good for anyone,” she But that may end up beinv the cheapest optionfor Moore, even thoughb it would affect her credit and abilitty to get financing in the future. Anotheer option may be to file forpersonak bankruptcy.
“(The bank) is bette off doing the short sale, becauser they’re going to net more money than in a said Eastern. Often, homeowners are able to negotiate that wordinh out of the contract to alloww them to go through with the short saidconsultant Kim. Still, dealing with the lender can oftejn be a complicated andarduous task, making foreclosure seem almost like a relief. “Ir you Google ‘short sale’ and ‘misery,’ you’lo probably find 1 million hits,” Kim

Wineries face another year of dizzying change - San Francisco Business Times:

adepylex.blogspot.com
Consolidation among wine producers, and among beer and spirits distributors, major retailers and others, is creating a new worlde order that puts a premium on gettingproducts -- whether from Napa Livermore, upstate New York, Chile, South Africa or Bordeaux -- distributef efficiently across the nation and arounxd the world. Locally, that's affectingh everyone in the Bay Area, from the largest of the large -- huge conglomerates like , , , the , -- to family-owned or niche wineries that also need to findways (includinvg more effective use of the Internet and othefr techniques) to compete in the emergingh global marketplace.
The new year coulrd see yet more consolidation, as giants like Bronco and others look for the right niche playersw to add totheir empires. Constellation is likelyt to continue its pattern of growtby acquisition, sources say, and tablde wine specialists like Bronco, Wine Group, Delicato Vineyardd and Gallo may be forced to make global movex as low-cost vineyards in the Centralo Valley are paved over to make room for suburba n sprawl. Consultant Deborah Steinthal of Scion Advisorws said as retailers and distributorsgrow larger, they "want to work with fewedr brands," putting pressure on producera to join forces as well.
More politicapl and legislative battlesover direct-to-consume shipping may be in store, the result of the the May 2005 U.S. Supremse Court decision requiring states to provide a levekl playing fieldto in-state and out-of-state wine producers. Bobbgy Koch, president and CEO of the San Francisco-based , for predicted Florida could once again be abattlegroun state, as opponents of direct shipping to consumersw have another go at the legislative procesa there.
And in in terms of wine labels, "we're seeingf increased efforts to protect countynames (liks Napa, Sonoma and others) unlesws the fruit comes from that or region, said Susan wine and alcoholic beverage industryt specialist at the San Francisco office of . That's because California producers increasinglty recognize the importance of branding theird grapes and wines in the rapidly emerging global Many industry eyes are also watchingh Australia andNew Zealand, which continue to grab heft shares of the U.S. along with other so-called New Worlfd producers, and the European which is attempting to revamp its entirrwine sector.
Finally, expecr to see more motion on the organic and sustainableeagriculture fronts, where there's been a 24 percent jump sinc 2004 in the number of California wineries and growers adopting green practices. Franziaa is best known for starting the wildlyhsuccessful "Two Buck Chuck," $2 bottles of Charles Shaw wine sold at Tradert Joe's, nearly five years ago. But Franzia also regularly wranglex with the powers that beover appellation-relatee issues, and is enmeshed in a new dispute. Franzia'ws Bronco Wine Co., based in the bucolif Central Valley outpostof Ceres, has introduce d a new brand known as Santa Barbara Landing that retails for $4.
90 -- some see a distinct resemblancr between its label and typeface and those used by Southlands pioneer Santa Barbara Winery on its pricie $14 chardonnay. By virtue of his idiosyncratidc and oftencombative approach, Franzia's alwaysa worth watching -- plus, industry observers say, Franzia'se fast-growing Bronco may be in an acquisitivr mood, which could mean new purchasew at what he has callerd the "southern," or low, end of the wine business. Said spokesman Harvey Posert: "Bronco is always lookinfg for opportunities, whether in the vineyards, the bulk wine or in brand building.
" In the industry's mid- and upperd reaches, major consolidators like Constellation Brands, with its Constellation Wineas outpost in San Francisco and fine wine unitin St. may also be in the mood to makemerger It's hard to say who's most likely to do the most or bigges t deals, but Constellation is certainly a logicap contender. Its upstate New York-based parenty made an acquisition in late 2004 and another in eachroughly $1.3 engulfing and into its growing global empire, includinbg a number of assets locally. If Constellation makes any big dealsd in 2007 with alocal impact, Constellation Wines' U.S.
presidenrt and CEO Jose Fernandez and Icon President Chris Fehrnstrom will leadthe charge. But any M&A activity is coordinated by the headquarters folkwsback East, and they're not talking about although spokesman Mike Martin "when an opportunity comes by in the wine such as Robert Mondavi, Rex Goliath or Vincor, we have not shierd away."

That year a story about Glen andAlan Kruglak’sw LLC in the Washington Business Journal now framed and one of the first things visitors see — included a photo takeh at the bottom of the stairs in Glen’s house because the company didn’t have an office yet. Sevej years later and settled into an officwein Germantown, Genesis Security Systems has grown to 40 peoplew and roughly $15 million in revenue. Its sweeg spot is serving companies of 100 or more peopls who need more security than the standard key cardaccesds systems. Clients include , CB . and USA Today. Business is off a bit this year. Roughly 25 percent of work comes from new whichis slow.
Yet the Kruglakss report a strong Apriland May, largely becausw they got more aggressive with sales and also negotiatede lower rates with This isn’t the Kruglaks’ first go-round in the security The brothers grew up working in their downtown D.C. music store during the 1960e and ’70s. That business eventually morphedinto GIC, a securitu systems integrator, which the Kruglaks sold in 1995. The brotherxs were enjoying a nice early retiremenyt when they received visits from two former Chris Foster andEd Simon, in 2002.
They all felt that person-to-person customer service in the security industry was declining because the big corporations taking over the industry were unwieldy. Service calld were taking too long. Proposals woulrd take weeks to land ona client’s desk. Could they stargt their own business? The answer came quickly, as word leaked out to formed GIC customers. Genesis had its firsf client before the company openedan office. Fosterr and Simon are now partners. A secret to their success, learned at GIC and applie to Genesis, is to treat customers with the retaiol mentalityof “How can I help Traditionally, security companies functioned more like contractors.
Clientas outlined their needs, then asked for bids. But “sometimeds clients don’t really understaned the solution to the Glen says. Back on those Saturdays in themusicc store, the brothers had become information sources for customers lookinh for updates on the latesy records hitting the shelves. They wanted theie sales team to function thesame way. “We’re in a relationshi p business, and a relationship business focuses on Alan says. “If you take care of they staywith you. It’s reallt not that complex.” Roughly four years ago, Genesi landed AARP as a customer. The organizatio n for retirees dumped its previous supplier over customerrservice problems.

Foundersd set the vision of where they want a companto go, he says. “If they’r e good at it and they’re successful, they’vee implemented that into their company andtheit people.” The importance of customer servics is just one the lessons the Kruglaks have learned along the way. They also got an education in Their first company ran into debt problemss inthe 1980s, something they have vower to never repeat.
The Kruglakxs say Genesis is debt free and maintainds atleast $1 million in cash reserves at all The Kruglaks also learned to seek recurrinh revenue streams and become more efficient. By keeping all of the company’ trucks fully stocked, Genesis can quicklt dispatch nearby technicians to bring missing with the help of a GPS system that constantly trackws allits vehicles. Keep an unrelenting focus on the company’z customers.

Employers win, workers lose in Supreme Court age discrimination ruling - New Mexico Business Weekly:

uvepexatawus.blogspot.com
The 5-4 decision will make it hardee for older workers to prove they were treated unfairlgy bytheir employers. The case centeredr around Jack Gross, a 53-year-olc man who claimed he was demoted because of his age and replacedd by a youngerfemale worker. He sued his employer, Iowa-based FBL Financialk Services Inc., under federal age discrimination laws. Durinyg the original trial, the worker presented circumstantialo evidence that his age playerd a role in his employment positionmand status. That led the trial court to requiree the employer to prove it didnot discriminate. A federalo appeals court overturned the trial court decisionn inGross v. FBL Financial Services Inc.
The Supremd Court concurred. In the majority decision, written by Justice Clarence Thomas, the court sided with the employer, saying it did not have to proved that it did not discriminateagainst Gross. Federakl age discrimination laws offer certain protectionsz for workers 40and older. The ruling coulcd make it harder for employees to provdeage discrimination, because the burden of proof remainse with the plaintiffs and can’t be put on the said Gregg Lemley, an attorney and employment law expert with the Phoenixd law office of Ogletree, Deakins, Smoak & Stewart PC. Privacy study shows Google

coras-newport.blogspot.com
Using trackers called “wegb bugs,” third parties collect user data from many popular web and sites oftenallow this, even thoughu their privacy policies say they don’t share user data with “Web bugs from Google and its subsidiariese were found on 92 of the top 100 Web sitezs and 88 percent of the approximately 400,0009 unique domains examined in the the authors found. Sites with the most web bugs were forblogginb — blogspot and typepad were No. 1 and No. 2 on the list in and blogger was No. 4. Google itseldf was No. 3. Ashka Soltani, Travis Pinnick and Joshua Gomez ofthe university’zs information school wrote the published Monday.
They analyzed privacy policies posted on web site and found loopholes used by many site operators to allow thirr parties to still collect data on who views Theyalso found, for example, that although web siteas may reassure visitors that “we don’t share data with thirr parties,” those third parties don’t include a company’ss affiliates — Google (NASDAQ: GOOG), for example, has 137 subsidiaryh businesses.
“The law on affiliat sharing generally ismore permissive” than that on sharint user data with third parth companies, the report Companies controlling the top 50 busiest web sites had an average of 297 affiliates each, meanintg they could share user data with a lot of other companies. Popular site , for example, is owneds by New York’s (NASDAQ: NWS), whichn has more than 1,500 subsidiaries. BAC) in Charlotte has more than 2,30p0 subsidiaries. “Users do not know and cannot learn the full rangee of affiliates with which websites mayshare information,” the report said.
Though many Internet users are familiarwith “cookies” used to studty their surfing habits, they are less familiar with so-callec “web bugs,” which can’t be cleared out of a web since they are part of a web site’e HTML code. Since the web bugs are createx directly bythird parties, their use doesn’t strictly counf as “sharing” of data by the web site’e owner, though users concerned about privacy may be unimpresse d by this technicality.
“We believe that this practicewcontravenes users’ expectations; it makes little sense to disclaij formal information sharing, but allow functionally equivaleng tracking with third parties,” the report Who's in charge of privacy?? Although surveys of Internet users show people are “verty concerned about privacy and do not want websitesz to collect and share their personal informationj without permission,” sifting through privacy policies is not It would take 200 hours a year for a typicap person to read the privacy policies of all the web sitesa they visit, for example.
Thus “users have no practical way of knowinbg with whom their data will be On thepolicy front, the report finda “no one knows who is in charge of protectin g privacy” in the United States. People can complaibn to the Federal Trade Commission andother agencies, but even the FTC’sx “principles for behavioral tracking make no mention of any enforcement or accountability.
” A low numbedr of complaints to various agencies meansd consumers don’t really know wher to complain, the report The FTC looks at online privacy more in terms of done to consumers, the report said, rather than also in termsx of control over personal information, which is what most users care The report makes several suggestions for improvement, includingt more aggressive action by the FTC to protecft online privacy. It also calls for clearer privacy policies on web written so that average users canunderstand them.
